Arthur was too unwell on the day of marriage to sign legal documents. The following year in Melbourne Clara signed a statement that she considered the marriage to be of doubtful validity. However, according to Wiki their form of marriage, with consumation, was not outlawed until the Marriage (Scotland) act 1939.
