According to a letter in November 1625 reporting raids on people considered Catholics which the then owner of Barton Hall, Barton Blount showed D T Merry during her visit, John Merry had land in Leicestershire and Barton, Derbyshire.

Wanted to be buried in Kirk Langley church with his wife. Left a tiny amount of money to brother William Merry noting that William bore him no love, was out to get what he could and had more than enough already. John left the lease of his Radbourne property and his estate to his housekeeper whom he made executrix. She was also to care for and educate the two children there. (Identity of children is unknown.)

The will was nuncupative, ie spoken on deathbed in the presence of witnesses.

Fact
In 1649 William Merry challenged the validity of the nuncupative will claiming that the housekeeper had lied about John's wishes. According to precis of records at Staffordshire Archives witnesses reported that John disliked his brother and intended his housekeeper to have a life interest in his estate. The precis stated an outcome. It was "draft sentence in favour of William was marked as rejected."
